Immigration court

If you have a case in immigration court, you have the opportunity to apply for asylum by attaching Form I-589 to your claim. This process is known as a "protective" asylum proceeding. It is highly recommended that you attend all immigration court hearings, as you will not face deportation while your case is pending.
