Application for accelerated processing

According to surveys, the processing time for work permit applications averages 3 months or more. And for other applications, such as advance parole or travel documents, the numbers are well over a year wait.

However, there is a way to speed up the processing of your application - by sending an Application for Expedited Processing to USCIS.

Individuals claiming immigration benefits have the opportunity to submit a request to expedite their applications or petitions. USCIS reviews each such request for acceleration on a case-by-case basis and may require additional documents in support of such a request. The decision to grant a request for acceleration remains the sole discretion of USCIS.

Reasons for acceleration may include the following:
  • Serious financial loss to a company or individual*
  • Emergencies and urgent humanitarian reasons
  • A request by a nonprofit organization in support of a cultural or social interest of the United States
  • U.S. government interests
  • Correction of an error made by USCIS

*Delay in filing the form or inability to provide requested additional evidence is not a valid reason for expedited review services.

Serious financial loss to a company or individual

A company can demonstrate that it will suffer serious financial loss, such as approaching bankruptcy, threatened loss of a significant contract, or layoff of employees. Obtaining work authorization alone, without proof of other compelling factors, is not grounds for an expedited resolution.

In addition, serious financial loss can also be proven in cases where failure to expedite would result in the loss of important public benefits or services.

This ground can help, for example, in obtaining work authorization. To do this, you need to provide information from your employer about how they need you as an employee and are willing to employ you as soon as possible. Preferably, the letter should include the consequences if you do the opposite, such as losing your contract. Also provide the company's contact details.

Emergencies and urgent humanitarian reasons

In the context of an urgent request, humanitarian reasons relate to human welfare. Reasons can be, but are not limited to, illness, disability, extreme life circumstances, family tragedy or an acute need for medical care within a limited period of time.

The desire to go on vacation does not usually meet the definition of an emergency.

This ground can help expedite your authorization to travel outside the United States. You need to describe your situation and provide all necessary documents in support.

Correcting a USCIS error

If you believe that USCIS made a clear error in rejecting your Form I-765, you can resubmit the form along with an Expedite request.

It is important to note that neither of these grounds guarantees expedited processing, and USCIS is not required to explain the reasons for denying expedited processing.
