Determining the date of the interview

The word "interview" is often associated with different situations. The same can be said of the word "trial. When we talk about the court process, it consists of one or two preliminary hearings and a final individual hearing. If you lose, you have the opportunity to appeal, with a 95% chance of losing, which takes the case to a new hearing with new data, and so on in a circle.

The interview, however, presents a more confusing situation.

1. The interview for those who arrived with a visa determines whether they will be granted political asylum (PA) immediately or sent to court, as is the case for many Mexicans.

2. The credible fear interview lasts from 3 to 6 hours. This interview is always conducted in the detention center, but very rarely at the border.

Beginning in 2022, those who are at large will be called in for an interview. You will receive a letter at the border inviting you to an interview at the address you provide. You will know the result the same day.

If you get a favorable decision at the interview, you have a reasonably good chance of winning in court. If you get a negative decision, it essentially means deportation and you will have to challenge the decision in court. You usually have no more than 24 hours to file an appeal.

3. The long, in-depth interview at the border is often confused with a credible fear interview. The difference is that you will not be given any "credible fear" documents. Also, different questionnaires and forms are used (although they may be similar). It is simply an expanded questionnaire regarding your personal information and the main points of your story. The result is the I-867 + I-831 form.

4. And here is the simplest type of interview, also called an interview (because really, what else can you call it). This is a short questionnaire to get you in and out of the system. It usually takes no more than 30 minutes. The result is an I-831 form.

There are times when you may not get some documents. However, an attorney can get this information from the officers and, based on your answers, develop a defense strategy so that nothing contradicts what you told the officer at the border or be prepared to explain the discrepancies.
