I-589 - documents to be sent to the court

At the top of the stack of documents must be:

1. Applicant's documents:
  • I-589
  • Copies of boarder/children's papers (I-94, I-862 Notice to Appear, I-220, I-385, etc.)
  • Copy of passport (all pages from cover to cover), if available
  • Copy of birth certificate, if available
  • Translation of birth certificate

2. Spouse's documents:
  • Copies of documents from the boarder/detention center
  • Copy of passport (all pages from cover to cover), if available
  • Copy of marriage certificate, if married and spouse is in the U.S.
  • Translation of marriage certificate

3. Child's documents:
  • Copies of boarder/child documents
  • Copy of passport (all pages from cover to cover), if available
  • Copy of child's birth certificate, if married and child is in the U.S.
  • Translation of the child's birth certificate

Additional evidence may be required (not necessarily immediately) such as:
When sending a package of documents to the prosecutor (the address of the prosecutor can be found here), all documents except the Proof of Service should be included.

Additional information:
  1. Send only copies of documents, not originals.
  2. [Optional] means your application will probably be accepted without it, but the instructions require it to be present.
  3. In rare cases, if you are applying on your own and do not speak English, a Declaration may be required.
  4. The cover sheet should contain the following information: your name, address, title of the document (e.g. APPLICANT'S APPLICATION FOR DETERMINATION AND DENIAL OF EXCEPTION), the full name of each alien listed on the application, a-number, type of proceedings (e.g. removal), date and time of the court hearing.
  5. Photographs must be recent, 2x2 inches in passport style. On the back of the photo, you should write your last name, first name, and a-number in pencil.
  6. If you do not have a marriage certificate or child's birth certificate, other proof of parentage, witness statements, or an explanation as to why these documents cannot be provided must be provided.
  7. If you want the court to return a copy of the I-589 with a stamp of acceptance as proof, you should mail an additional copy of the I-589 to the court and enclose a postage-paid, stamped addressed envelope.
  8. You can call the court to make sure your case is accepted.
